Casita Eskwela Terms of Service

Casita Eskwela is a school management and learning platform provided by Jomiecode Foundry OPC ("Jomiecode Foundry", "we", "us"), a one person corporation registered in the Philippines [[TO CONFIRM: SEC registration number and registered address]]. These Terms apply to everyone who uses Casita Eskwela with an account: school staff in the staff portal, and parents, guardians and learners in the family app.

By signing in to Casita Eskwela you agree to these Terms. If you do not agree, do not use Casita Eskwela and tell your school. Please also read the Privacy Policy, which explains how personal information is handled and what your rights are.

1. Who these Terms are between

• These Terms are between you and Jomiecode Foundry. They sit alongside the rules your school sets for its own community.
• Your school subscribes to Casita Eskwela under a separate agreement with us (the "school agreement"). That agreement governs what the school pays, the service levels we promise the school, and our duties to the school as the processor of its data. You are not a party to it.
• Where these Terms and the school agreement differ on a matter between us and the school, the school agreement prevails. Nothing in either takes away your rights under the Data Privacy Act of 2012.

2. Learners and minors

• Most learners are under 18. Under the Civil Code a minor cannot give consent to a contract, so a parent or guardian accepts these Terms for a learner who has an account, and guides the learner's use of it.
• Learners below a grade the school sets (Grade 7 unless the school chooses otherwise) do not have their own account. Their family uses the parent or guardian account instead.
• For learners, these Terms work as the school's rules for using Casita Eskwela. If a learner breaks them, the school deals with it under its own policies, including its child protection policy.

3. Your account

• Your school creates your account and decides what you can see and do.
• Keep your password to yourself, and do not share your account.
• Staff whose work includes handling money must use two-step sign-in with an authenticator app. Anyone else may turn it on in My account. If you lose your phone, ask your school to reset it.
• Tell your school straight away if you think someone else has used your account.
• Your school can suspend or close your account, for example when a learner leaves or a staff member's employment ends.

4. Acceptable use

You agree not to:

• use another person's account, or let anyone use yours;
• look at, copy, download or change records you are not entitled to, or try to get around access controls;
• use information from Casita Eskwela for anything other than the school purpose it was given for, including keeping learners' or families' details for your own use;
• upload anything unlawful, harmful, defamatory or infringing, or anything containing malware;
• upload, share or ask for sexual material involving a child. We remove it, keep what the law requires us to keep, and report it to the authorities;
• use Casita Eskwela to bully, harass or threaten anyone, or to send messages the school has not authorized;
• scrape, overload, reverse-engineer or test the security of the service without our written permission. If you find a security weakness, tell us (section 15) and do not use it.

5. Suspension by us

We may suspend or limit access if it is needed to protect learners, the school, other users or the service, or if the law requires it. Where it is urgent we may act first and explain after. We tell the school, and you where appropriate, the reason as soon as we can, and we restore access once the risk has passed. What happens to your account after that is the school's decision.

6. Records and content

• School records (enrollment, grades, attendance, fees, school forms and similar) belong to the school. We process them only on the school's instructions, as the Privacy Policy describes.
• Content you add (messages, files, submissions, lesson material) remains yours or the school's, as agreed between you and the school. You give us permission to store, copy, display and process it only to run Casita Eskwela for your school, for as long as the school needs.
• You are responsible for having the right to upload what you upload.
• We may remove content that breaks these Terms or the law, or that the school asks us to remove.

7. Our software

Casita Eskwela, including its software, its design, and the sample lessons and slide decks we supply, belongs to Jomiecode Foundry or its licensors. We give you a personal, non-transferable right to use it for your school's purposes while your account is active. You may not copy, resell or build a competing product from it. If you send us suggestions, we may use them freely.

8. Third-party services

• Lesson videos may play from YouTube, in its privacy-enhanced mode. The video is linked, not copied onto Casita Eskwela, and YouTube's own terms and privacy policy apply when you play it.
• Online payments, when your school turns them on, go to the school through a payment provider under that provider's terms. Fees, refunds and receipts are between you and the school. Any convenience fee, and who receives it, is shown before you pay. Online payment is not yet available.
• Text messages and email are sent through the providers listed in the Privacy Policy.

We choose these services carefully and list them in the Privacy Policy, but we do not control them and are not responsible for their own terms or content.

9. Availability and changes to the service

We work to keep Casita Eskwela available and secure, but we do not promise it will be uninterrupted or error-free. We announce planned maintenance in the app where practical. We may change or improve features; if a change removes something you rely on, we or your school will tell you in advance where practical. Any service level we commit to is in the school agreement.

Demonstration environment. Sites on `jomietech.com` are our demonstration environment. They hold sample data only and may be reset at any time. Do not enter real learner or family information there.

10. Liability

• We are responsible for loss caused by our fraud, bad faith or negligence, as the Civil Code provides. Nothing in these Terms waives liability for fraud or bad faith, or your rights under the Data Privacy Act, including the right to damages.
• Otherwise, and as far as the law allows, we are not liable for indirect or consequential loss, or for loss caused by the school's decisions or records, by misuse of your account, or by events we could not foresee or avoid, such as natural disasters or widespread power or internet outages.
• Our liability to the school is set by the school agreement.

11. Ending use

• You can stop using Casita Eskwela at any time by asking your school to close your account.
• Your access ends when the school closes your account, or when the school's subscription ends.
• When a school's subscription ends, the school is suspended and receives a full copy of its records. What happens to the records after that is set out in the Privacy Policy (section 10). Ask the school for copies of your own records.
• Sections 6, 7, 10, 13 and 14 continue to apply after your use ends, as far as they are relevant.

12. Changes to these Terms

We may update these Terms. For a significant change, we tell you in the app and by email at least 30 days before it takes effect [[TO CONFIRM: notice period]], unless the law requires a change sooner. If you keep using Casita Eskwela after that date, the new Terms apply. If you do not agree, stop using Casita Eskwela and ask your school to close your account. Earlier versions are available on request.

13. Law and disputes

• Philippine law governs these Terms.
• Please raise a concern with your school, or with us, first. We aim to resolve it within 30 days.
• Disputes go to the proper courts of [[TO CONFIRM: city of the registered address]], without prejudice to any right the law gives you to bring a case where you live, and to your right to complain to the National Privacy Commission.

14. General terms

• Severability. If a court finds part of these Terms invalid, the rest stays in force.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about your use of Casita Eskwela.
• No waiver. If we do not enforce a term straight away, we may still enforce it later.
• Transfer. We may transfer these Terms to a company that takes over Casita Eskwela, after telling the schools; your rights under them do not change. You may not transfer your account.
• Notices. We send notices to you in the app or to your account email. You can send notices to us at the addresses in section 15.
• Language. These Terms are written in English [[TO CONFIRM: whether a Filipino version will be published]]. Any unclear wording is read in your favor.
